This has become somewhat of a big thing recently. Kurt Russell in the last Tron movie, Peter Cushing in the new Star Wars movie, Anthony Hopkins in Westworld...

While it's dazzling and interesting, it makes me wonder...are there any kind of legal/IP problems down the road? I'm assuming Peter Cushing's family/trust gave Disney and Lucasfilms the thumbs up. But, that's just an assumption. 

What if a studio went forward without either asking, or receiving permission? Would they have rights to the actor's image and voice?

In some states, you would be required to obtain the permission of the estate but in others not.  There is no uniform rule.
