Sorry, Allen -- Jazz Lips is a bootleg label; can't sell bootlegs here. See forum rule 7:

but seriously, would I not be able to sell a Fresh Sound CD?

looking again, that rule 7 seems to have an altogether different purpose. And what if this is non-copyrighted material?

do whatever you gotta do, I guess, but rule 7 seems aimed not at commerce but at illegal file sharing, This is not that.

Fresh Sound and other European labels like that are releasing recordings the artists originally gave permission for that are now in the public domain in Europe and therefore legit there. They're not bootlegs. Releases of live recordings the artists never gave permission for are bootlegs.

When I was still a moderator forum rule 7 was also aimed at selling bootlegs.

That depends on how you define "bootleg" (I think this is a good definition: "a recording of a performance that was not authorized by the artist"), but you're right, Fresh Sound and other European public-domain releases are indeed illegit in the United States as far as they're not yet in the public domain in the United States at the time of release.
